Appeal fees will need to be paid to lodge an Immigration and asylum appeal

 From 19th December 2011, the Ministry of Justice will be introducing appeal fee charges for some asylum and immigration appeals.  In order to appeal against a decision notice on or after 19thDecember 2011, a fee has to be paid by an appellant. Though there will be fee exemptions for certain decisions, including for deportation, removal of illegal entrant or overstayer, EEA appeals and appellants on asylum support, the introduction of fee charges is looked at as if an harsh interference towards an appellant seeking justice from an independent tribunal particularly for those appellants who are abroad and appealing without being represented by a lawyer. In addition to the fee charges, it will no longer be possible to lodge appeals with the entry clearance post abroad.

The fee will only apply for appeals to the First Tier Tribunal. The fees will be applicable for per appeal as:

  • £80 where there is no hearing and
  • £140 where there is an oral hearing.
