In criminal proceedings, appeals are usually against sentence, confiscation orders or conviction or in complex cases there can be 'interlocutory appeals' on complex points of law.

If permission to appeal is obtained, the appeal hearing will be heard in the Crown Court (if the case was originally heard in the Magistrates Court) or in the Court of Appeal (Criminal Division).  In certain circumstances cases may be referred to the CCRC - Criminal Cases Review Commission or the ECHR - European Court of Human Rights.

One of our most high-profile pieces of appeal work was not against sentence or conviction but on a point of law.  We represented an individual in an SFO prosecution relating to allegations of illegal price fixing in the pharmaceutical industry called Operation Holbein.  We were successful in defending the SFO appeal to the House of Lords and as a result, the investigation against our client was stopped.

There are various reasons why there may be grounds to appeal against sentence, confiscation and/or conviction.   The amount of work involved depends on the nature of the complaint.  Appeals against confiscation orders and conviction can be the most complex.  If there are grounds to suggest that a serious miscarriage of justice has occurred then considerable work may need to be undertaken including in some cases gathering new evidence.
